Fraud & reporting policy

We want Race and Rally Market to be a safe place to trade. This policy explains how you can report suspicious listings or users, what we do with a report, and how we handle personal data when fraud is suspected, within the rules of the GDPR (AVG) and the EU Digital Services Act.

1. How to report

Report a listing or user as soon as something feels wrong: a price that is too good to be true, a seller who asks you to pay outside normal methods, photos copied from elsewhere, or a seller who refuses to show the part. Tell us which listing it is, what happened and, if possible, add screenshots of the conversation. You will receive a confirmation that we received your report.

2. What we do with a report

  • We review every report within 48 hours.
  • If there is a serious risk, we can hide the listing straight away while we investigate.
  • We check the listing, the account history, the verification data and the messages on our platform.
  • Depending on the outcome, we may remove listings, remove the Verified seller badge, or suspend or permanently close the account.
  • We tell the account holder which measure we took and why, and how they can object, unless the police ask us not to while they investigate.
  • We tell the person who reported whether we took action. We do not share another user’s personal data with them.

3. If you have lost money

Stop all contact and do not make further payments. Contact your bank immediately: some payments can still be stopped or recalled. File a report (aangifte) with the police in your country. In the Netherlands you can also report online fraud via the Fraudehelpdesk. Mention the listing and the date in your report.

We cannot hand over the personal data of the other party to you directly. We do cooperate with the police and other authorities: when they make an official legal request for data, we provide the data we hold.

4. Personal data when fraud is suspected

  • What we keep: the account details, listings, verification data, platform messages and technical log data of the account involved, and the content of the report.
  • Why: to investigate the report, protect our users and the platform, and to be able to answer official requests from the police. Our legal basis is our legitimate interest in preventing fraud (art. 6(1)(f) GDPR) and, for official requests, a legal obligation (art. 6(1)(c) GDPR).
  • How long: during the investigation, and for up to 12 months afterwards. If a police case is ongoing, we keep the relevant data until it is closed.
  • Internal block list: if we close an account for fraud, we keep a minimal record (e-mail address, phone number and verified name) for up to 2 years, only to prevent the same person from registering again. This list is used only within Race and Rally Market and is never shared with other companies or published.
  • No public naming: we never publish names or details of suspected fraudsters.
  • Your rights: anyone whose data we process can ask to access, correct or delete it, and can object to a decision. If we refuse a request, we explain why.

5. Objecting to a decision

Do you think we removed your listing or suspended your account by mistake? Reply to our message with your explanation. Someone who was not involved in the original decision will review it.

6. What we do not do

  • We do not act as a payment or escrow service and cannot refund payments between users.
  • We do not guarantee the condition, legality or homologation of items sold.
  • We do not share block lists with other platforms.
